Thus the
Patent Reform
Act of 2007 would have essentially eliminated important public interest projects
such as the Electronic Frontier Foundation's
Patent Busting Project, which uses inter and ex parte reexamination proceedings to challenge and defend against
patents that potentially infringe on the public domain.45
In this
way, the
Patent Reform
Act of 2007 would have failed to replace the current reexamination processes with an adequate form of post grant review.
