The application judge concluded that the Appellant had
a pecuniary interest at stake, and that his actions in speaking to and voting on the matter did not result from inadvertence or an error in judgment.

The severe penalty
at stake required a strict interpretation of the threshold of how
pecuniary interest is defined, as it is not defined in the Act itself.
So, a contractor or the closing attorney, who both have a
pecuniary interest in the transaction and get paid for the transaction to occur, can be notaries
at closing.
