place under their waiver plans do not have to change them.

waivers, which are now in
place in 42 states, Puerto Rico, and the District of Columbia, allow states to get out from
under many of the mandates of the NCLB law in exchange for embracing certain education redesign priorities.
The U.S. Department of Education on Thursday denied a request by the state's top education official to extend a flexibility
waiver under the No Child Left Behind Act, a decision that will
place restrictions on nearly $ 30 million in annual federal funding for local school districts beginning with the 2015 - 2016 school year.

place under No Child Left Behind.
The Politics K - 12 Team at Education Week surveyed all 50 states regarding their use of «super subgroups» in their NCLB
waivers that «can no longer be used in
place of individual subgroups of student for accountability purposes»
under ESSA.
Data dashboards can help alleviate some of the shortcomings in accountability systems that have been in
place in the wake of NCLB and the systems that states have implemented
under waivers to that law.
The entire
waiver process was sloppily administered in the first
place, with Duncan granting
waivers to states (and allowing them to ignore whole sections of No Child) even thought they have not yet implemented or enacted all the proposals within their applications, and the administration ignoring concerns raised by its own peer review panels about such matters as how states have ignored the need to gain consultation on proposed changes from American Indian tribes as required
under the U.S. Constitution (as well as from black and Latino communities equally affected by the evisceration of accountability).
The administration has also ignored red flags raised by peer review panels it has put in
place to vet the submitted proposals — including concerns that states didn't present their proposals to American Indian tribes as required
under both the
waiver process (as well as
under federal and state laws), and that D.C.'s plan for implementing Common Core reading and math standards was not «realistic and of high quality».
As the Center on Education Policy noted in its recent survey of states granted
waivers under the gambit, there is already fears that they will have scotch the accountability systems they put in
place after receiving the
waivers and start all over again
under a new version of the federal education law.
What these reformers should do now is call upon the Obama Administration to call off the
waiver gambit, fully embrace the approach to accountability put in
place under No Child, and begin negotiating with congressional leaders on a reauthorization of the law as it should have done a long time ago.
As mentioned in last week's Capitol Connection, Harkin's bill eliminates the Adequate Yearly Progress (AYP) model and allows states to use the accountability and teacher evaluation systems in
place under No Child Left Behind (NCLB)
waivers or to create new systems that establish their own student academic performance standards.
The
waiver is also available to any child who was in DCF care
under a Care and Protection petition for 12 consecutive months, and was neither adopted nor returned home (including children who were
placed in guardianships).
