ALBANY — State Senate Majority Leader John Flanagan says the creation of a special prosecutor to
investigate police killings of civilians would represent a «radical departure» from traditional grand jury procedures.
District attorneys are still searching for more clarity on their role now that Attorney General Eric Schneiderman has been granted the power of special prosecutor in cases
involving police killings of civilians.
And that closeness is a conflict,» Cuomo said on July 8, 2015 when signing an executive order that empowers the Attorney General to take over investigations
of police killings of civilians from local District Attorneys.
Cuomo's executive order made a splash nationally, and New York remains one out of nine states to take action on investigations
into police killings of civilians as of early 2017.
State Attorney General Eric Schneiderman's office will prosecute a case today involving
the police killing of a civilian for the first time since Cuomo granted Schneiderman authority to investigate such incidents.
