An eyewitness while narrating what happened said a
policeman opened fire on a soldier

This far wider test of liability has been applied to found liability where an off - duty
policeman carried out a shooting: Bernard v Attorney General of Jamaica [2004] UKPC 47, and to a bouncer who,
after work, followed and stabbed a customer with whom he had had an
argument: Mattis v Pollock [2003] 1 WLR 2158.
