Predictive Coding, which, at times, can be
more confusing than helpful.
Predictive Coding and
Technology Assisted Review («TAR») help ameliorate a problem that denigrates civil litigation: extortion by discovery when discovery costs «force settlements for reasons and on terms that related
more to the costs of discovery than to the merits of the case.»
However, emerging
technologies that allow users to «train» software to distinguish between relevant and non-relevant documents (typically known as
predictive coding, or
technology assisted review) are making internal review much
more viable (learn much
more about this in the Review section of this guide).
Technology - assisted review (TAR), such as
predictive coding software, can help attorneys manage this process
more efficiently.
While the language used is
more understated than the SDNY opinion, the holding is essentially the same:
Predictive Coding is a judicially defensible
technology to use in appropriate matters.
As with Da Silva Moore, this decision will cast a spotlight to make practitioners
more aware of the
technology, opening the door to the variety of ways that
Predictive Coding can be defensibly deployed and leveraged.
Using
predictive coding /
technology assisted review / whatever it is called, is faster,
more accurate and a heck of a lot cheaper than human review.

predictive coding will argue that many of those complexities are largely hidden from actual users of the
technology, the promise of cheaper,
more efficient e-discovery has yet to outweigh the fear of the unknown for many lawyers.
