This exception permits covered entities to use or disclose protected
health information when discussing topics such as the benefits and services available
under a
health plan, the payment that may be made for a
product or service, which providers offer a particular
product or service, and whether a provider is part of a network or whether (and what amount of) payment will be provided with respect to the services of particular providers.
Because the definition of «
health plan» excludes many types of insurance
products (in the exclusion
under paragraph (2)(i) of the definition), we would consider an entity that has one or more of these lines of insurance in addition to its
health insurance lines to come within the definition of «hybrid entity,» because the other lines of business constitute substantial parts of the total business operation and are required to be separate from the
health plan (s) part of the business.
Under § 164.504 (c)(3), an entity may create a
health plan component which would include all its
health insurance lines of business or separate
health care components for each
health plan product line.
