Rather than creating a single definition of «research information,» we allow covered entities the flexibility to define that subset of
protected health information they create during clinical research that is not necessary for treatment, payment, or health care operations and that the covered entity will use or disclose
under more limited
circumstances than it uses or discloses
other protected health information.
As in the proposed rule, a covered entity may deny access to
protected health information
