ruling in Stubbings v Webb [1993] AC 498, 1993] 1 All ER 322, which held that claims arising from intentional assaults were governed by s 2
of LA 1980), and held that an intentional assault fell within LA 1980, s 11, and was therefore subject to a three - year limitation period, which could be extended by reference to knowledge (s 14), or at the court's discretion (s 33), rather than
under LA 1980, s 2, which while
providing for a more generous six - year limitation period, was nevertheless not extendable in any circumstances by the court.
Where a litigation matter is considered appropriate for the Commercial List, it can proceed
under the special Commercial List practice
rules, which aim to
provide for a more direct, involved and rapid resolution
of the matter before a judge with specific experience in that area

This difficulty is compounded by the fact that traditional
laws and customs are transmitted orally from generation to generation, so evidence
of these may be restricted or inadmissible
under the hearsay
rule.137 This is an issue that has been identified by the Australian
Law Reform Commission in its Review
of the Uniform Evidence Act 1995.138 The Commission proposes that the uniform Evidence Acts should be amended to
provide an exception to the hearsay and opinion evidence
rules for evidence relevant to Aboriginal or Torres Strait Islander traditional
laws and customs.139 The Commission also observed that there are strong arguments that the NTA should be amended as the relevant provision does not
provide sufficient guidance on or certainty on the admissibility
of evidence in native title proceedings.140 However, legislative amendment to the NTA falls outside the terms
of reference
of this review.
Finally, the Commission would like to note that some
of the recommendations made in the submission are to amend the Native Title Act to
provide for powers or procedures that are potentially already possible
under the
law, such as
under the Federal Court
of Australia Ct 1976 (Cth) or Federal Court
