There are several legalization bills floating in the
state Senate that address some aspects
of drug policy, like
state Sen. Nicholas Scutari's, but
none that include all the
provisions that Sinha believes advocates want to see in a piece
of legislation.
(e) This section is intended to confirm and clarify existing law that
none of the
provisions of this chapter, other than the
provisions of subdivision (1)
of Section 5 -19-1 and Section 5 -19-3, apply to any transaction that is not a consumer transaction, or, where provided in subsection (a) to any transaction involving an interest in real property, whether or not a consumer transaction, to any transaction
of a trust institution described in subsection (a), or to any municipal pension system created under the laws
of the
State of Alabama described in subsection (a).
The Court has moreover had occasion to
state in that regard that, although the mere fact that a Member State has created a dominant position by the grant of exclusive rights is not as such incompatible with Article 82 EC, the EC Treaty none the less requires the Member States not to adopt or maintain in force any measure which might deprive that provision of its effectiveness (judgments in ERT, C ‑ 260 / 89, EU: C: 1991:254, paragraph 35; Corbeau, C ‑ 320 / 91, EU: C: 1993:198, paragraph 11; and Deutsche Post, C ‑ 147 / 97 and C ‑ 148 / 97, EU: C: 2000:74, paragraph
