The Education Legislation Amendment Act 2008 maintains commitments to initiatives such as the Sporting Chance program, as well as supporting the expansion of intensive literacy and numeracy programs for Indigenous students, professional development support to assist teachers to develop Individual Learning Plans for their Indigenous students, an additional 200 teachers in the Northern Territory and the provision of three new boarding college facilities for Indigenous secondary school students in the Northern Territory.

Finally, a new Illinois provision bans the use of BPA in reusable bottles and cups for young children, and the District of Columbia enacted a provision requiring the development of regulations prohibiting the use of pesticides near most schools and child - occupied facilities.

Special provision funding is for local authorities to create places for pupils with special educational needs and disabilities (SEND), and to improve facilities for them in mainstream and special schools, nurseries, colleges and other education providers.

A number of the Shared Responsibility Agreements and other funding initiatives have already been introduced that involve activities that are intended to have a significant health benefit.325 These include the «no school, no pool» policy; provision of sport and recreation facilities or equipment; support for market gardens and nutrition programs; through to support for women's groups and child care services.

The Equality Duty states that: It is unlawful for the responsible body of a school to discriminate against, harass or victimise a pupil or potential pupil in relation to admissions, the way it provides education for pupils, provision of pupil access to any benefit, facility or service, or by excluding a pupil or subjecting them to any other detriment.
