The Charities Act 2006 (ChaA 2006) is the current incarnation of the 1601 law and what is new in the Act is
the public benefit test (expected to be in force in March 2008) under which the «advancement of education» may fail to retain its charitable status if it produces insufficient public benefit as that term is defined, not in ChaA 2006, but at common law.
The Act created new charitable purposes, explicitly mirroring government policies and, more crucially, appeared to attempt to convert a non-ministerial regulatory body, the Charity Commission, into a law making one, with power, in the guise of satisfying
the public benefit test, to end the life of any of the 183,506 registered charities — Catholic adoption agencies and public schools being its most recent targets.
The public benefit test was recently considered, albeit not in a media merger context, by the Full Federal Court in ACCC v Australian Competition Tribunal [2017] FCAFC 150 (Tabcorp) where the Court applied a broad concept of public benefit consistent with the Fairfax decision in New Zealand:

Putting all three
