In 2003, the Louisiana State Legislature created Act 9, which allowed for the State

Secondary Education (BESE) to seize responsibility of a
public school deemed failing and establish and govern the RSD, with the BESE able to continue to oversee the operation of traditional schools or create charter schools (Louisiana Legislature, 2003).
