Usually when I call a
lawyer in the middle of the work day, I get someone who sounds annoyed, in a hurry, and doesn't
really want
to talk to me.
So you and I met the last guest I had too, we met at Ernest Benson's small firm boot camp and we started
talking, and I always
really appreciate these very nuanced conferences because any
lawyer that shows up at these
really sort of boutique conferences have a different mindset about the way they approach their practice and the things that they're going
to learn and the things that they're interested in.
I think that's sort of the reason that I don't like
to talk about Windows that much is because
lawyers are on all these different versions of Windows and it
really makes it difficult
to speak consistently about it.
But we thought we'd take a little bit of a break from that and
talk more about its purpose and why we built it, which is that in law practice and small firm law practice if you are a creative business person or an innovator or tech oriented or trying
to think up ways
to better serve clients that haven't been tried before, we've found that that can be
really isolating and that there can often be a lot of active resistance from other
lawyers, from bar associations, from regulators, and that it can just be a
really strange experience
to be someone trying
to make your business better, make the world better, and
to feel alone or
to feel like people are actively trying
to stop you from doing that.
We're
really looking forward
to talking to lawyers about our Rocket Lawyer On Call ® program, as we exhibit for Practice Management Day at the New York State Bar Annual Meeting.
We
talked to Andy Haugen a little while back about how he likes
to say yes, and it led
to some
really great opportunities for his practice, but I also feel like saying no is one of the most important skills that a
lawyer, anybody in business, but a
lawyer can have.
What he's
talking about is when you're billing somebody monthly for a service, that's a habit and they just do it because maybe they like you, maybe their loyal
to you, but eventually they go while I'm not
really getting the value from this, which is why it's so important for
lawyers to make sure that clients appreciate the value their giving.
That's all the liaisons, the judges and everybody else and frankly a lot of people just thought I was absolutely crazy but I got a lot of thank you's over time and as we
talked about it more, we get a magazine that focused on mindfulness and Jeena Cho, who you know who's now published The Anxious Lawyer, was
really getting some traction at the same time and it just kind of ignited and there's been a lot of traction on mindfulness since then and I was glad
to be at least a small part of that, introducing the
lawyers in this state
to mindfulness.
If you are
talking to a
lawyer that wants
to charge more than that amount, you should
really consider shopping around.
I was
talking to one of my
lawyers I think last week and I was asking him how things are going and are you having any client problems and his answer
to me was so telling because he said I actually
really like all my clients right now.
These are some
really good tips about how
to talk with a
lawyer.
It
really is important
to be organized before
talking with a
lawyer.
There has long been a sense that
lawyers really don't feel the law societies are the best way
to be governed and while many have said it
to me personally, it was almost impossible
to get anyone
to talk about it on the record.
You
really need
to talk to an experienced criminal defense
lawyer and start building a strong defense.
Then you can present that
to your client and you feel confident that's the right number, they feel confident because of the reasons we had just
talked about and I think you'll find that a lot of
lawyers will get over that hurdle is whatever system or tools you have, whether it's an Excel file, whether it's your billing system, figure out a wan
na to lay out all your tasks, assign your rate
to it, and then track in real time, so you can
really tell, «Does it
really take me two hours
to do this task, I always thought it did», but as it turns out it usually takes me three.
This month's cover story, and
really a lot of the
talk of the town here in Ontario, centres on the shortage of articling spaces for all the
lawyers in training graduating from law school and wanting
to get into the practice of law — or at least who want
to get called
to the bar so they can tick it off their list of accomplishments and then go on
to run a successful enterprise using their law - school smarts!
The other paper that
really inspired me was a paper by Ed Marks, New Mexico Legal Aid's Executive Director, published in MIE that
talked about how
lawyers have an ethical obligation
to use state of the art tools
to manage their practices and provide services.
Tom Mighell: If I compare, and maybe this is a way
to transition
to talking more about the ABA survey, I
really don't find that as many
lawyers embracing new or cutting edge technologies as maybe we've seen in the past.
And so, there's a lot of people
talking about AI right now but what they
really mean is firms should subscribe
to some end -
to - end tool that uses AI at some point in the process; and so, we thought it will be better if law firms and
lawyers could become makers if they could learn
to use the tools themselves and
to create things anew.

to pay less, and are not
really interested in concepts like sharing risk.
Plenty of private practice
lawyers talk a good game about being commercial (and
to be fair, some of them do have an excellent grasp of their clients» businesses), but there are plenty who glaze over when faced with a discussion of what's
really important
to their clients.
Within the firm itself, I think it would it be great if
lawyers could see it as a place where we could dissect the things that don't go as well as we would like and not think then there's going
to be a separate conversation with the partners
talking about how that person is
really not up
to snuff.
Short of getting my hands on these books, what I'd
really like would be the image of a definition from each, isolated as such, along with a transcription and, where necessary, a translation of each;
talking about a dictionary without
talking about definitions sounds too much like one of the hostile definitions of
lawyers you hear: a person who can think about something that's related
to something else without thinking about the thing that it's related
to.
And then I think finally, the last way that I'm
really excited about and not sure if Dennis, you're going
to be involved in this or not, but I know something that I definitely want
to do during this year is
to put together some type of tech news roundup that we do, whether it's on our own, whether it's with our friends at Legal
Talk Network or however that winds up happening, I definitely want
to go out there and do something more, a different kind of a podcast that's a shorter form, something that gives us slightly different set of information than we give on this podcast but it still is sharing things that
lawyers need
to hear about technology.
And of course another thing that's
really hard on
lawyers and it's what I do for a living mostly and why I am always surrounded by them is
talking about technology and finding and figuring out ways
to not be tortured by technology, that sounds terrible.
So I wanted
to go back
to where my roots
really are which is in technology and training and helping
lawyers, so thought, I'd ask you
to come on and we can
talk about Microsoft, let's
talk about Microsoft subscriptions, and maybe if there is anything new and exciting that
lawyers might not know about or might not have realized that is part of Microsoft, we can sort of dig into all those things.
It
talks a little more about the decision
to divorce and choosing a
lawyer etc, but when it gets
to the good stuff it is
really good and direct.
