In determining the common
law reasonable notice period, courts consider a number of factors including the employee's age, level of position, length of employment, and any recruitment issues.
In addition to the Bardal factors, Iacobucci J., writing for the majority, considered the impact of inducement on the period of
reasonable notice period at paragraph 85 writing:
In 2016 the Ontario Court of Appeal in Lin v. Ontario Teachers» Pension Plan16 held at paragraphs 52 to 55 that a relevant consideration when determining the
appropriate reasonable notice period was the fact that the plaintiff's dismissal «under an ethical cloud» would make it more difficult for the plaintiff to find comparable employment.

The determination of the common
law reasonable notice period has always been considered somewhat of an art rather than based on a scientific formulaic approach.

Generally, income that is earned by an employee after he or she is terminated from employment during

In the wrongful dismissal proceedings, the judge concluded that twelve months was
a reasonable notice period in the circumstances.
However, the table of sample notice periods produced at page 6 - 40.3 of the Sproat, Wrongful Dismissal Handbook gives a strong indication of the extent to which inducement by the employer is a factor in determining
the reasonable notice period.
[57] In my assessment, economic factors aside,
a reasonable notice period for Mr. Gristey would have been twelve (12) months.
[56] So what would
a reasonable notice period be in these circumstances?
Thus, the Court did not simply find that the plaintiff's failure to mitigate began when he stopped looking for work in the final three months of his common law
reasonable notice period.

It confirms that the court can grant judgment prior to the expiry of
the reasonable notice period - as in this case, the court awarded 17 months of pay in lieu of reasonable, despite the fact that Mr. Paquette had only been out of work for 7 months at the time.

In normal circumstances, a dismissed employee is entitled to be paid all the remuneration the employee would have received had he or she worked through the «
reasonable notice period».
This case is a timely reminder for employers in relation to two issues: (1) the standard of misconduct that qualifies as «just cause»; and (2) the potentially significant liability that an employer can incur when a wrongfully dismissed employee becomes disabled during his or
her reasonable notice period.
