Organizations must also report to the Office

Privacy Commissioner
of Canada as soon as possible
regarding any data
breach which poses such a
breach.
The Court reached the same conclusion
regarding the «without claim / colour
of right» issue — an issue that speaks to an essential element
of a
breach of privacy claim.
In this
regard, there seems to be general agreement that the use
of unauthorised personal data is unlawful in most domestic legal systems and under international law (it is at the very least a
breach of the human right to
privacy).
