The court adopted the reasoning in U.S. v. Chon, 210 F. 3d 990 (U.S. Court of Appeals for the 9th Circuit 2000), which
rejected the notion that the PCA would not apply on the basis that the officer was a member of the Naval Criminal Investigation Service (NCIS), which is a largely
civilian operation headed
by civilian command.
