A new
report released today by the National Alliance for Public Charter Schools outlines the complex maze
of laws governing special education and recommends best practices charter schools can use to strengthen the recruitment
of and services provided to
students with disabilities.
Indeed, less than a year before the Coleman
Report's release, President Lyndon Johnson had signed the Elementary and Secondary Education Act into
law, dedicating federal funds to disadvantaged
students through a Title 1 program that still remains the single largest investment in K — 12 education, currently reaching approximately 21 million
students at an annual cost
of about $ 14.4 billion.
But, it raises profound challenges to the interpretation
of score trends on high - stakes tests, to the meaning
of achievement trend and gap
reports in terms
of percent proficient, to the interpretation
of crossnational achievement comparisons, and to popular assumptions about testing
of students in special populations (including some assumptions written into
law).
This left districts with a choice: delay the issuing
of report cards until the scores are available «sometime this month» OR seek a waiver from state
law mandating that TCAP scores count toward a
student's final grade.
Bellwether's
report focused on the
law's requirements for holding schools accountable: whether the state sets high academic standards, how it will use federal money to identify and raise achievement for the lowest - performing 5 percent
of schools and the lowest - performing groups
of students in all schools.
According to Valerie Strauss in her Washington Post Answer Sheet blog, the study found that «the
report, together with a number
of other studies released in the past year, effectively serve as a warning to policymakers in states that are moving to implement
laws, with support from the Obama administration, to make teacher and principal evaluation largely dependent on increases in
students» standardized test scores.»

Accusation: The ACLU
report found many instances
of enrollment violations regarding
