Here are the specific provisions in the TFSA legislation that would allow taxpayers to
request a
waiver of
tax payable:
Taxpayers may
request a penalty abatement on the basis of 1) an administrative
waiver (i.e. bad advice from a
tax practitioner), 2) reasonable cause (i.e. a death in the family), or 3) an IRS error.
To
request a
waiver of the penalty
tax, you should forward a detailed written
request to the TFSA Processing Unit in Ottawa with all relevant information, including: your name, address, telephone number, social insurance number, the name of your TFSA issuer, the amount of
tax for which a
waiver is being
requested and the years involved.
