(d) Discrimination or segregation by an establishment is supported by State action within the meaning of this title if such discrimination or segregation (1) is carried on
under color of any law, statute, ordinance, or regulation; or (2) is carried on
under color of any custom or usage
required or enforced by officials of the State or political
subdivision thereof; or (3) is
required by action of the State or political
subdivision thereof.
Nothing in this title shall be deemed to exempt or relieve any person from any liability, duty, penalty, or punishment provided by any present or future law of any State or political
subdivision of a State, other than any such law which purports to
require or permit the doing of any act which would be an unlawful employment practice
under this title.
'' (3) Any amount deducted from gross income
under section 164 of the Code as state, local, or foreign income tax or tax, as state or local general sales tax tax, or as qualified motor vehicle tax to the extent that the taxpayer's total itemized deductions deducted
under the Code for the taxable year exceed the standard deduction allowable to the taxpayer
under the Code reduced by the amount the taxpayer is
required to add to taxable income
under subdivision (4) of this subsection.subsection (a2) of this section.»
For purposes of this section, the term «cap and trade program» means a system of greenhouse gas regulation
under which a State or political
subdivision issues a limited number of tradable instruments in the nature of emission allowances and
requires that sources within its jurisdiction surrender such tradeable instruments for each unit of greenhouse gases emitted during a compliance period.
(ii) if the individual possessing the firearm is licensed to do so by the State in which the school zone is located or a political
subdivision of the State, and the law of the State or political
subdivision requires that, before an individual obtains such a license, the law enforcement authorities of the State or political
subdivision verify that the individual is qualified
under law to receive the license;
The limits of such uninsured motorist bodily injury coverage shall be equal to the highest limits of bodily injury liability coverage for any one vehicle insured
under the policy; provided, however, that (i) the limits shall not exceed one million dollars ($ 1,000,000) per person and one million dollars ($ 1,000,000) per accident regardless of whether the highest limits of bodily injury liability coverage for any one vehicle insured
under the policy exceed those limits and (ii) a named insured may purchase greater or lesser limits, except that the limits shall not be less than the bodily injury liability limits
required pursuant to
subdivision (2) of this subsection, and in no event shall an insurer be
required by this
subdivision to sell uninsured motorist bodily injury coverage at limits that exceed one million dollars ($ 1,000,000) per person and one million dollars ($ 1,000,000) per accident.
The limits of such underinsured motorist bodily injury coverage shall be equal to the highest limits of bodily injury liability coverage for any one vehicle insured
under the policy; provided, however, that (i) the limits shall not exceed one million dollars ($ 1,000,000) per person and one million dollars ($ 1,000,000) per accident regardless of whether the highest limits of bodily injury liability coverage for any one vehicle insured
under the policy exceed those limits, (ii) a named insured may purchase greater or lesser limits, except that the limits shall exceed the bodily injury liability limits
required pursuant to
subdivision (2) of this subsection, and in no event shall an insurer be
required by this
subdivision to sell underinsured motorist bodily injury coverage at limits that exceed one million dollars ($ 1,000,000) per person and one million dollars ($ 1,000,000) per accident, and (iii) the limits shall be equal to the limits of uninsured motorist bodily injury coverage purchased pursuant to
subdivision (3) of this subsection.
Note: The applicant may apply to the Family Court or to the Federal Circuit Court of Australia for the application for the parenting order or for the proceedings
under Subdivision E of Division 13A of Part VII, or both, to be transferred to the Federal Circuit Court of Australia or to the Family Court, as the case
requires (see section 33B of this Act and section 39 of the Federal Circuit Court of Australia Act 1999).
