Such an argument, based on the
Rules can not succeed in the light of the directly comparable position
under the English CPR and the decision of the Supreme Court in Abela v Baadarani [2013] UKSC 44, where a similar argument was
run, based on the
different Sections of CPR 6 which made provision for service inside and outside the jurisdiction and in the light of the general power given to the Court by RDC 9.1 to «order otherwise».
That
rule specifies which businesses are so similar to a solicitors» business that they must be
run as such if solicitors are the owners; those which differ to some extent, and so may or may not be
run separately at the option of the owners; and those which are so
different that they must be
run under a
different umbrella.
