school districts to retain ineffective teachers while
cutting other areas of education spending or laying off more effective teachers when faced with funding deficits.
A coalition of
school districts last month notified the state that it would
file new litigation, alleging that recent education
cuts are unconstitutional.
The court ordered a dismissal of the Dwyer lawsuit, which was
filed by a group of parents and
school officials in June 2014 claiming the state is unconstitutionally
cutting school districts» funding by going against Amendment 23.

The lawsuit — which was
filed in 2011 and became the longest legal battle over
school finance in state history — was brought against the state after the Legislature
cut $ 5.4 billion in public education funding from the state budget while
schools were already struggling to implement new academic standards.
