This very varied evidentiary legislation situation, will produce a very inconsistent caselaw, one jurisdiction to the next, once judges and lawyers realize the consequences in law required by the fundamental difference between an electronic record and a pre-electronic paper record — in particular, the «system integrity concept» that is expressly stated in the electronic records provisions; e.g.: s. 34.1 (5), (5.1) of the Ontario Evidence Act; and, s. 31.2 (1) of the Canada Evidence Act (see my Slaw blog article, «The Dependence of Electronic Discovery and Admissibility upon Electronic Records Management,» published Nov. 22, 2013).

Although I take no credit for being a catalyst in this development (see my SLAW rant here from over 1 year ago), I am extremely pleased with the product and have already used it to print a nice PDF of one of the cases reported in it.
Although I have been a regular reader of Slaw for many years, this is the first time I have felt compelled to comment on a post, as I am truly disappointed to see Slaw used as a forum to redistribute unattributed government PR materials verbatim.
It is truly disappointing to see a Slaw posting on the issue with no legal analysis whatsoever, much less an informed policy analysis.
This document captures the action - oriented strategies, reforms and innovations from leaders in the access to justice field in response to the recommendations made by the Action Committee in their final report, A Roadmap for Change (see a SLAW summary here).

I only had bagged kale, so the slaw was more like a salad... and had to use white wine vinegar instead of red, so next time I'll «fix» those two items and see if they still like it!

A problem, though, again citing the draft of my next Slaw article, can be that one sees some of the more traditionally - minded entrants not knowing how to evolve, not being capable of understanding processes and technical elements and being hostile to change.
