to do so, there will be no innovation, which is why the unaffordable legal
services problem exists, i.e., the absence of
such pressure on law
societies has allowed law
societies to carry on without evolving in their management structure, and not sponsoring the necessary support
services.
Everything done by benchers, including
such «Dialogues,» prevent change in regard
to two critically important factors that perpetuate the problem: (1) law
society management structure and its 19th century conception of a bencher; and, (2) the method by which the work is done
to provide legal
services.
Law
societies refuse
such proposals, as if
to say, the present method is the only possible method by which
to produce legal
services.
But because law
societies in Canada have done nothing
to try
to solve the unaffordable legal
services problem («the problem»), they have undercut their ability
to prosecute them for UPL for the reason that
such organizations are not themselves licensed lawyers.
Law
societies should be sponsoring
such support
services so as
to take advantage of this important management principle: «nothing is as effective at cutting costs as scaling - up the volume of production.»
Of perhaps even greater note, however, is that in December, B.C.'s legal
services regulatory framework task force recommended that «the Benchers seek an amendment
to the Legal Profession Act
to permit the Law
Society to establish new classes of legal
service providers
to engage in the practice of law, set the credentialing requirements for
such individuals, and regulate their legal practice.»
The necessary components for
such a management structure already exist, which include the precedent set for
such a «law
societies» civil
service» by Ryerson University in Toronto and the University of Ottawa by establishing LSUC's bilingual LPP (Law Practice Program); see: Access
to Justice — Unaffordable Legal
Services» Concepts and Solutions» (SSRN pdf., August, 2017).
Closely related would be a national institute for advising law
societies how
to deal with major problems
such as the unaffordable legal
services problem which afflicts the majority of the population.
Such an agency would be accountable
to the political process,
to which law
societies in Canada are not because of a lack of government surveillance as
to how law
societies justify their use of their monopoly over the provision of legal
services.
LIZ would have no competitors providing
such a civil
service function for all of Canada's law
societies, and paid for by enabling CanLII
to provide at cost a legal opinion
service as does LAO LAW at Legal Aid Ontario.
In June 2017, the ABS Working Group presented an interim report
to Convocation outlining a proposal
to enable lawyers and paralegals
to deliver legal
services through civil
society organizations,
such as charities, not for profit organizations and trade unions,
to clients of
such organizations in order
to facilitate access
to justice.
The strategy of
such commercial, highly competitive producers is based upon affordability and maximizing the use of automation and its very rapid progress from the simple
to the complex
service — the very things that law
societies should be helping law offices
to achieve.
Given that many more
such problems will occur for which law
society management structures are incapable
to cope due
to obsolescence, it would provide the permanent and developing expertise function that a civil
service provides
to an elected government.
Finally, a global initiative hosted by the United Nations and led by high profile policymakers, including US Supreme Court Justice Anthony Kennedy, has recommended the liberalization of the regulation of legal
services in order
to allow nonlawyers and community - based organizations and advocacy groups
to provide legal
services to the poor, stating that «it is likely
to improve access
to justice for the poor substantially while imposing relatively few costs on
society,» and that a «major attraction» of
such liberalization is that it may require «fewer government or donor expenditures.»
Only then will law
societies feel enough motivation
to create the necessary solution,
such as enabling CanLII
to provide the legal
services to lawyers that LAO LAW provides.
Collectively, lawyers are encouraged
to enhance the profession through activities
such as: (a) sharing knowledge and experience with colleagues and students informally in day -
to - day practice as well as through contribution
to professional journals and publications, support of law school projects and participation in panel discussions, legal education seminars, bar admission courses and university lectures; (b) participating in legal aid and community legal
services programs or providing legal
services on a pro bono basis; (c) filling elected and volunteer positions with the
Society; (d) acting as directors, officers and members of local, provincial, national and international bar associations and their various committees and sections; and (e) acting as directors, officers and members of non-profit or charitable organizations.
The longstanding massive damage and misery being caused by the unaffordable legal
services problem (the «accesses
to justice» (A2J) problem) compels this conclusion: the problems of law
societies are now
such that they need an agency that performs a civil
service function — one
to serve all of Canada's law
societies.
