The new
smartphone design patented by Samsung reveals a device with an oval - shaped frame and a wraparound display that puts key function buttons on the back of the device.
Apple prevailed on
its smartphone design patents but lost on the tablet - related one.
Before the jury verdict came down, Judge Koh (in a preliminary injunction ruling last year) and many observers (including me) thought that Apple had a stronger case with its tablet design patent, while
the smartphone design patent case looked like a closer call.
From a damages point of view,
the smartphone design patent part of the case is the real moneymaker for Apple here, but this is about stopping infringement more so than about money, and from an IP enforcement point of view, the D'889 patent is presumbly no less important to Apple than those iPhone design patents.
I would argue that the combination of these two outcomes related to design patents doesn't make sense, but Apple's
smartphone design patent case is strong enough that a jury can find that way, and the tablet design patent case is so strong that Apple may very well get the jury overruled either by Judge Koh or on appeal.
Yesterday Samsung was awarded yet
another smartphone design patent that's based on a tri-fold display.

In terms of the
design of the phone, Samsung's CEO admitted that the
design of the phone was explicitly created to circumvent Apple
design patents, with a slightly tapered
design that is unlike any iPhone model on the market, in an obvious nod to currently ongoing litigation while the size of the phone is meant to resemble a miniature tablet rather than any conventional
smartphone, with an elongated teardrop shape.

Ratinoff's
patent litigation practice includes representing computer
design and manufacturing companies, data storage device manufacturers,
smartphone and tablet makers, network security providers, semiconductor and memory chip fabricators, and computer software companies.
Obviously,
design patents covering the shape of a tablet or
smartphone are not an Android issue.
I didn't disagree with the 2012 jury's verdict (apart from validity and the fact that I would have actually seen a stronger
design patent case in connection with tablets than with
smartphones, as Judge Koh did in her preliminary injunction decision as well) nearly as much as with its approach.
As a result, the Court vacated a $ 399 Million damage award against Samsung Electronics Co. in a lawsuit alleging infringement of
design patents covering features of Apple, Inc.'s iPhone
smartphones and sent the case back to the Federal Circuit Court of Appeal for further analysis.
But the whole problem would go away if «article of manufacture» was interpreted more narrowly, given that two of the
design patents in question relate to only the outer cases of
smartphones.
The Federal Circuit's holding would require awarding Apple all of Samsung's profits for sales of a
smartphone containing any Apple
design patent, even a trivial one.

Only a part of the CCIA's argument (the part that explains a disgorgement of total profits for one
design patent can't be the answer since Apple holds multiple
smartphone - related
design patents, in which case a damages claim could theoretically amount to many billions of dollars) is duplicative of the professors» simultaneous filing.
On August 24, 2012, a jury deemed this
design patent valid and infringed by 11 Samsung
smartphones (mostly Galaxy devices).
However, I can't see how the existence of other
smartphone - related
patents (utility
patents as well as
design patents) would not have probative value: the single strongest argument for a narrowly - defined article of manufacture (just the casing) simply is that there is so much more in and on a
smartphone than just a very few, narrow
designs.
Apple argues that this
smartphone case has different characteristics than Samsung's hypothetical example of a disgorgement of total profits could affect the manufacturer of a car only because of a cupholder infringing a
design patent.
On remand, the Federal Circuit will have to decide whether «the relevant article of manufacture for each
design patent... is the
smartphone or a particular
smartphone component.»
The
patent for «flexible display devices» — which was filed in July 2014 — features a touchscreen
smartphone with a
design popularized by clamshell phones.
The
patent shows a rounded
smartphone design with a transparent screen.
The latest
patent comes from Samsung, which just this week was granted a
design patent on a
smartphone featuring a transparent display, according to Patently Apple.

smartphone design, except this time the fold isn't evenly proportioned and adds a clear component that allows the user to view a large lip area that exposes either app icons or live alerts of incoming email or text messages.
