[93] In the Native Title Report 1997, the
Social Justice Commissioner Mick Dodson raised concerns that state or territory
legislation (none of which provided for acquisition for the benefit of a third party interest at this stage) would be amended to allow acquisitions for private purposes.
The
Social Justice Commissioner has an independent monitoring role on the impact of government activity on the exercise and enjoyment of human rights by Australia's Indigenous peoples, and reports annually to Australia's federal Parliament on the status of enjoyment of Indigenous human rights (the
Social Justice Report) and the impact of native title
legislation on the enjoyment of Indigenous human rights (the Native Title Report).

To promote transparency and accountability, I believe that the Attorney - General should be required by
legislation to table a response to the
Social Justice Report and the Native Title Report in Parliament within a set timeframe.
All
legislation to be non-racist and to adhere to
social justice principles.
The Aboriginal and Torres Strait Islander
Social Justice Commissioner (the
Social Justice Commissioner) has also developed a ten - point plan in the
Social Justice Report 2007 that articulates how the NTER
legislation could be made consistent with the RDA and human rights standards.
The
Social Justice Report 2007 noted that the Minister had the authority under the NTER
legislation to declare the anti-discrimination
legislation to have effect, as a short term measure, until legislative amendments to this end were in place.
