Creighton also points out that journalists who care deeply about accurate science reporting will already have some sort of standard review built into their process that should bring these kinds of issues to light before publication.
The study, which was featured in the August 9, 2010 issue of Nature magazine and later published in the peer - reviewed journal Environmental Science and Technology, raises serious doubts about the industry's contention that there is no need for tighter water - quality standards to keep mountaintop removal from contaminating drinking water relied on by communities downstream of the mines.
This highlights the larger issue of standards in the peer review process.
Finally, we comment on several policy issues arising from this controversy: the lack of consistent requirements for disclosure of data and methods in paleoclimate journals, and the need to recognize the limitations of journal peer review as a quality control standard when scientific studies are used for public policy.
With use of standard wording, one has the ability to refer to past judgments to get clear interpretations of the text issued and reviewed by judges.
The Court of Appeal began its analysis by determining that because the resolution of issues raised involved the legal effect of undisputed facts, the appropriate standard of review was correctness.
The Court of Appeal noted that the question at issue was statutory interpretation, which is a question of law and attracts a standard of correctness on review.
The court stated by way of introduction that, «the issue of the standard of review applicable to orders of both judges and prothonotaries has been one of the most contentious issues before our Court and before all courts of appeal, including before the Supreme Court of Canada, in the last 10 to 15 years.»
The accessibility standards in the AODA are also proactive in nature, requiring training prior to any incidents, the development of appropriate policies with reviews, and modifying the workplace to prevent issues before they emerge.
The Supreme Court of Canada has been feverishly productive in the field of administrative law since the Fall of 2011, rendering decisions on standard of review (questions of law, jurisdictional error and labour arbitrators), the right to reasons, issue estoppel, attempts to pre-empt the administrative decision - making process, and review of municipal by - laws.
In this short piece, I will first review Justice Stratas» contribution on the issue of standard of review in light of the Court's holding in Dunsmuir.
Finally, I will attempt to outline a path forward on the issue of standard of review, again relying on Justice Stratas's apt suggestions.
