The week features a mix of reflective pieces on the nature of legal research and writing and the teaching and learning of the same in legal education, and substantive posts students wrote about their major memo legal research.

My day - one poll of the students generally suggests some feel uncertainty about their legal research and writing skills as they prepare to enter the profession, and they take the course almost as «remedial legal research and writing,» to borrow the words of a colleague.

For example, periodic, pop - quiz - style research simulations might help students to see that they don't know what they don't know about legal research.54 Either way, they need to understand that running searches is a means to an end.

In short, the more that students know about legal analysis, the more confidently they will approach the research process, regardless of the tools they use or the order in which they use them.

No doubt about it; we are teaching a generation of students who have done no significant research (of any kind) in print.57 Because other online research seems so easy, they generally underestimate the effort involved in conducting thorough legal research.

A comment by Karen Sawatzky on Simon's Scrolling post inspired me to think about the language that is most appropriate when teaching law students legal research.

Indeed, if American legal education is truly serious about the globalization of law, we should demonstrate that belief by including global legal research in the toolkit of essential skills that students are expected to acquire.

Southwestern Law School, for example, has incorporated empirical research on lawyers» careers into a class in its mandatory first - year curriculum: «Professionalism explicitly grounds the course through the introduction of case studies of lawyers» careers that have been drawn from empirical research...» 23 Indiana University's Mauer School of Law has introduced a four - credit first - year course on the Legal Profession that similarly involves students in learning about lawyers» careers using empirical research and discussions with practicing lawyers.24 Interestingly, in both cases, the deans of the law schools themselves are part of the professor team teaching these new first - year courses.

We are used to developing substantive expertise in unfamiliar legal issues.95 An effective LRW problem needs to challenge the students to think creatively about research, to use the available sources effectively, and to take on the role of counselor or advocate.96 Including the world broadens the possibilities for problem issues and enriches existing problems by adding a new dimension.

In my own research on legal education, I demonstrated that a key shortcoming of the traditional intellectual apprenticeship lies precisely when students start to think about the contexts of law cases in complicated ways.

It talks about this legal research course on using books, but then undermines the focus by having primarily negative comments from students who have taken the course.

One was the seemingly neverending question of how to encourage students (or the Google generation) to use print materials (and also as contrasted to electronic versions of print products, as John notes) in their research; another example was in a panel discussion among legal publisher representatives about the future of print.

By the time I meet law students, they have had the benefit of learning about legal research in the academic setting.

Questions were raised about how much students get out of blogging, especially in writing short pieces (if that is all they do), and Moin gave a strong defence of the merits of having students blog on a common theme over the course of several weeks as an organic, multi-faceted approach to legal research and writing.

This energizing day was not only a wonderful pro bono opportunity for our students to put their legal research and synthesis skills to a purpose they felt passionate about, but also an unexpected experiential learning effort.

And for students, using legal issues that they have already researched or written about, reduces the number of new legal issues that students need to research, learn, and explain in a first year that is already brimming with legal topics.

Criticisms of part - time programs continued through the 1950s and 1960s, and some scholars questioned the viability of certain instruction in part - time programs due to concerns about the ability of part - time programs to teach students legal research and writing in addition to questions about whether these programs provided adequate seminars for students.42 These critics essentially argued that evening programs were not capable of preparing students under ««modern conditions.

Hearing the complaints about this course gave me a new respect for the Legal Research and Writing instructors who have the courage to teach a course that few students grasp the long - term importance of or even have the courtesy to pretend that they can stand.
