of defense or enforcing your obligations hereunder) resulting from or arising out
of any breach
of any
of your representations or misuse
of this or any
other USTA Family
of Companies site or
of any site linking to this or any
other USTA Family
of Companies site.
Entrants agree to release and hold harmless the Bloggin» Mamas, Heather Lopez Enterprises, LLC, Florida Prepaid, Moore Communications, Twitter, and any
other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting this giveaway, and their respective parent,
subsidiaries, and affiliates and each
of their respective officers, directors, members, employees, agents and subcontractors (collectively the «Released Parties») from and against any and all claims, expenses, and liability, including but not limited to negligence and damages
of any kind to persons and property, including but not limited to invasion
of privacy (under appropriation, intrusion, public disclosure
of private facts, false light in the public eye or
other legal theory), defamation, slander, libel, violation
of right
of publicity, infringement
of trademark, copyright or
other intellectual property rights, property damage, or death or personal injury arising out
of or relating to a participant's entry, creation
of an entry or submission
of an entry, participation in this giveaway, acceptance or use or misuse

«Credit Services
Organization» does not include any
of the following: (i) a person authorized to make loans or extensions
of credit under the laws
of this State or the United States who is subject to regulation and supervision by this State or the United States, or a lender approved by the United States Secretary
of Housing and Urban Development for participation in a mortgage insurance program under the National Housing Act (12 U.S.C. Section 1701 et seq.); (ii) a bank or savings and loan association whose deposits or accounts are eligible for insurance by the Federal Deposit Insurance Corporation or the Federal Savings and Loan Insurance Corporation, or a
subsidiary of such a bank or savings and loan association; (iii) a credit union doing business in this State; (iv) a nonprofit
organization exempt from taxation under Section 501 (c)(3)
of the Internal Revenue Code
of 1986, [FN1] provided that such
organization does not charge or receive any money or
other valuable consideration prior to or upon the execution
of a contract or
other agreement between the buyer and the nonprofit
organization; (v) a person licensed as a real estate broker by this state if the person is acting within the course and scope
of that license; (vi) a person licensed to practice law in this State acting within the course and scope
of the person's practice as an attorney; (vii) a broker - dealer registered with the Securities and Exchange Commission or the Commodity Futures Trading Commission acting within the course and scope
of that regulation; (viii) a consumer reporting agency; and (ix) a residential mortgage loan broker or banker who is duly licensed under the Illinois Residential Mortgage License Act
of 1987.
(7) Directly or indirectly, as determined by the commissioner, through any affiliate,
subsidiary, related person, or otherwise, charge or receive any money or
other consideration or thing
of value for the performance
of any service which the credit repair services
organization has agreed to perform, or represented that it will perform, for any buyer before such service is fully performed.
The reference is to the conversion
of major segments
of the industry from independent companies or franchise
organizations into
subsidiaries or divisions
of corporate conglomerates whose principal business is
other than real estate — such as MidAmerican Energy Holdings and GMAC, both mentioned above.
