(B) provide that special consideration will be given to the REHABILITATION under this ACT
of a handicapped individual whose handicapping condition arises from a disability
sustained in the line
of duty while such individual was performing
as a public safety officer and the proximate cause
of such * disability was a criminal ACT, apparent criminal ACT, or a hazardous condition
resulting directly from the officer's performance
of duties in direct connection with the enforcement, execution, and administration
of law or
fire prevention, firefighting, or related public safety activities;
A new case out
of the Massachusetts Supreme Judicial Court (SJC), the highest state court, looks at whether a woman who had a valid prescription for medical marijuana, but failed her employer's drug test due to it and was
fired as a
result, could
sustain a claim for handicap discrimination.
