In a new Education Next article «A Bad Bargain: How
teacher collective bargaining affects students» employment and earnings later in life,» Michael Lovenheim and Alexander Willén
of Cornell University
present the first evidence that students» exposure to a duty - to - bargain
law while in elementary and secondary school lowers future earnings and leads to fewer hours worked, reductions in employment, and decreases in labor force participation.
Advocates and community groups — including the Chicago
Teachers Union, Raise Your Hand for Illinois Public Education, Equip for Equality, the Shriver National Center on Poverty
Law, the Ounce
of Prevention Fund and the Access Living disability rights group —
presented their concerns to ISBE in November.
The
law encourages local districts to submit
teacher pay proposals for the pilot that could look like one
of two distinct models: either pitch a plan that would reward
teachers on the basis
of how well their students do on tests, or
present an idea for paying
teachers who work in hard to staff subject areas or rural / high poverty schools and / or taking on additional leadership roles to improve student success.
James E. Ryan, dean
of the Harvard Graduate School
of Education, said the university has three goals: improve the quality
of classroom
teachers in urban schools, create a model that can be copied elsewhere, and
present teaching as a viable career to Harvard students and their peers who do not typically think
of K - 12 teaching in the same vein as
law, medicine or business.
The proposal, which was prompted by the scandal enveloping the Los Angeles Unified School District over the long career
of former Miramonte Elementary School
teacher Mark Berndt, who now faces 23 charges
of what the
law politely calls lewd acts upon a child, arose the ire
of the two unions because it would have allowed school districts to suspend
teachers accused
of alleged sexual and substance abuse crimes without pay and allowed dismissals to be
presented before an administrative
law judge instead
of the usual three - person panel
of the state's Professional Competence commission that is largely slated in favor
of NEA and AFT.
To win the contest, the states had to
present new
laws, contracts and data systems making
teachers individually responsible for what their students achieve, and demonstrating, for example, that budget - forced
teacher layoffs will be based on the quality
of the
teacher, not simply on seniority.
As it appears to violate federal copyright
law, I don't see how it will be allowed to continue, but if it isn't stopped, sheer ignorance
of one's rights could prevent
teachers and students from being more creative and openly
presenting their work.
Reading between the lines
of the
present case, the school board and the CLP apparently took umbrage at the
teacher's temerity in claiming her statutory rights, evidence perhaps
of a disconnect between
law - in - the - books and
law - in - practice and lingering discomfort amongst employers about assertive employees.
