Doing large budget cuts
through budget extenders is a lousy way to run a large government; and likely illegal.
A key component of the Senate GOP's lawsuit against the prisoner counting change included in the 2010 - 2011 budget is a challenge to the way that switch was made —
through a budget extender bill sent to the Legislature by then - Gov.
(Recall that Cuomo has more than a passing interest in this lawsuit, since it challenges his right as governor to make policy

This doesn't necessarily mean there won't be different circumstances where the Legislature isn't more willing to really test the impact of preferring a «shut down» of the government option to capitulation to the Governor's position
