However, evidence obtained
through an illegal search is not necessarily inadmissible; there is a
judicial discretion to admit illegally obtained evidence if its admission would not operate unfairly against the accused.
These other dimensions include respect for minority rights, reconciliation of Aboriginal and non-Aboriginal interests
through negotiations, fair procedural safeguards for those subject to criminal proceedings, respect for Crown and police
discretion, respect for the separation of the executive, legislative and
judicial branches of government and respect for Crown property rights.
