The way the parties and professionals interact with one another is radically different, the way information is gathered and assessed are different, and the way clients work together (with advice) to make solid decisions in their divorce that takes into account all of the legal, emotional, and financial elements in the divorce is a far cry from putting on a case at trial and asking the Judge to make all of the decisions.

In the plan, you describe whether you and your spouse will exercise joint legal custody, making important decisions regarding your child together, such as education, religion and health care, or if only one parent will have this responsibility through sole custody.

Joint legal custody allows each parent to have an equal say in the child's welfare: they must make decisions together about the child's education, housing, religion, healthcare, and so on.

Legal custody refers to the decisions you and your spouse would have made together if you remained married.

Parents may share both physical custody, with each providing a home for the child, and legal custody, meaning the parents make decisions together on major issues affecting a child's welfare, such as education, health care and religious training.
