726 — Any ADVERTISEMENT or incentive or the offering of any incentive or the participation
in an incentive program to the public as an inducement to
trade in real estate undertaken or
authorized by a registrant shall not be: (a) false; (b) inaccurate; (c) reasonably capable of misleading the recipient or intended recipient;
«Advertising» means any notice, announcement or representation directed at the public that is
authorized, made by or on behalf of a registrant and that is intended to promote a registrant or the business, services or
real estate trades of a registrant
in any medium including, but not limited to, print, radio, television, electronic media or publication on the internet (including websites and social media sites).
Misleading or untruthful advertising, including the use of the term «Realtor» ™ by a person not
authorized to do so, or using any other
trade name or insignia or membership
in any
real estate association or organization, of which the licensee is not a member;
(2) A person who is providing
trading services to or on behalf of an expropriating authority,
in relation to the expropriating authority's acquisition of
real estate it is
authorized to expropriate, is exempt from the requirement to be licensed under Part 2 of the Act
in respect of those services if all the following apply:
