The New York City teachers union, the UFT, created the charter school intending to demonstrate that running a school
under the city's
collective bargaining
agreement was
not an impediment to success.
... The problem raised by attempts to escape the contract tribunal so as to seek enforcement in the courts of rights arising
under a
collective agreement negotiated within the framework of a
collective bargaining regime, solely on the grounds that the
agreement does
not explicitly address the jurisdictional question, is an equally profound difficulty.
43.1 (1) At any time on or after the day that is 45 days after the Minister makes an appointment
under subsection 43 (5), if the parties have
not entered into a
collective agreement, either party may apply to the Board to direct the settlement of a first
collective agreement by mediation - arbitration.
(16) Except where a
collective agreement states that this subsection does
not apply, an arbitrator or arbitration board may extend the time for the taking of any step in the grievance procedure
under a
collective agreement, despite the expiration of the time, where the arbitrator or arbitration board is satisfied that there are reasonable grounds for the extension and that the opposite party will
not be substantially prejudiced by the extension.
(7) Where a trade union or council of trade unions is declared to be the bargaining agent
under subsection (6) and it is
not already bound by a
collective agreement with the successor employer with respect to the employees for whom it is declared to be the bargaining agent, it is entitled to give to the employer a written notice of its desire to bargain with a view to making a
collective agreement, and the notice has the same effect as a notice
under section 16.
In a statement on the Queen's web site, it states: «Any survey of an institution's copying
under the provision of this licence would respect the principles of academic freedom, would
not extend to faculty emails or interactive portions of learning management systems, and would acknowledge each institution's
collective agreements.»
Instead, the two parties entered into a new
agreement that wasn't governed by the Labour Relations Code or enforced by either party as a

not afforded additional benefits beyond the eight week period either
under a

agreement or written employment policy or contract are
not afforded job protection if their maternity leave exceeds eight weeks.
