Exempt persons are required to keep a record, using the Report of all use of methyl bromide by critical
use exemption holders form provided by the Department of the Environment, of the details of every use of methyl bromide under their critical use exemption, including where a contractor performs the fumigation.
The Non-QPS
exemption list, for an
exemption year, lists the individual
holders of critical
use exemptions, their nominated suppliers (who they may only purchase their non-QPS stocks of methyl bromide from in the
exemption year) and the maximum quantity of methyl bromide that they may purchase from that supplier.
Sellers may supply non-Quarantine and Pre-Shipment methyl bromide to a person who has a current critical
use exemption approved by the Parties to the Montreal Protocol (an exempt person) only if the seller is listed as the nominated supplier for that exemption holder on the current non-Quarantine and Pre-Shipment Exemption List (and, if also required, the non-Quarantine and Pre-Shipment Intermediate Supplier List - see below) under the Reg

But patents are more restrictive, says Niels Louwaars, director of Plantum, a plant breeder's association in Gouda, the Netherlands: «When one trait in a plant is patented, you are in principle not allowed under the research
exemption to
use such materials for further breeding» without the patent
holder's permission, he says.
