The IDC and Assembly sponsors of a bill that would legalize
the use of medical marijuana in New York amended the measure late last night to address some — but not all — of Gov. Andrew Cuomo's publicly stated concerns.
While it may be tempting to stigmatize the use of medical marijuana or make assumptions about an employee's abilities, employers should approach an employee's
use of medical marijuana in the same way as the use of any medically - prescribed drug with intoxicating effects.

Illinois is one of 29 states in the country to permit
the use of medical marijuana in certain situations.

While the drug remains illegal
in the eyes
of the federal government, 29 states have passed legislation that allows for

The bill forbids local authorities from working with federal agents, including
using «agency money, facilities, property, equipment, or personnel to assist a federal agency to investigate, detain, detect, report, or arrest a person for commercial or noncommercial
marijuana or
medical cannabis activity that is authorized by law
in the State
of California.»
And since California began allowing
medical marijuana in 1996, 22 other states and Washington, DC, have followed suit, permitting the
medical use of the drug
in some form.
Marijuana's position
in the top tier
of the scheduling system — which organizes drugs by their «acceptable
medical use and... abuse or dependency potential» — has endured since the 1970s.
It's also unclear that the increased
marijuana use by pregnant women represents drug abuse; for instance, nausea and anxiety (both common among pregnancy) are among the most common symptoms
of medical marijuana users, which may
in part explain the increase
in usage.
Medical marijuana is now legal
in 23 states and Washington, D.C., with five
of those jurisdictions permitting recreational
use.
Nor will taxes be applied to oils that contain low amounts
of THC, the primary psychoactive element
in marijuana, that are
used by children with certain
medical conditions.
Marijuana is illegal under federal law, but so far eight states and the District
of Columbia have legalized the drug for recreational
use, while 28 states
in total have legalized
medical cannabis.

In the closing hours
of the legislative session, Governor Andrew Cuomo signed off on an approach to
medical marijuana legislation that will allow its
use under carefully controlled circumstances.
In his July debate with Tom Suozzi, Spitzer, apparently eager to disagree with his opponent during the «lightning round,» shocked members
of his own staff by saying he was against
using marijuana for
medical purposes.
New York City Councilman Antonio Olivieri, who died
of cancer
in 1980 at age 39, had lobbied for state
medical marijuana use for therapeutic research.
Medical marijuana experts say that home deliveries are growing across the state, helping to sustain a budding industry
of suppliers, some
of whom have struggled financially after the drug was approved for
use in January.
Even though Obama said
in 2008 that he considered the «basic concept
of using medical marijuana for the same purposes and with the same controls as other drugs prescribed by doctors... entirely appropriate» and did not plan on
using the DOJ's resources to circumvent state laws, the department has continued to raid, and
