At issue was whether, in adjusting an at - fault total loss claim (a «write - off» of the vehicle), insurers could continue the standard practice of subtracting the amount of the deductible under the insured's policy from the actual cash value paid to the insured, when the insurer retained title to the salvage (the «totalled» car).

The appellant asserted that, since Intact had not paid Brennan for the value of the vehicle, Intact was not, at that time, either the owner of the vehicle, nor was it «any other person entitled to» the vehicle under s. 24 (1) of the RSLA.

Under Idaho law, the insurance company is required to pay the lesser of two amounts: either the cost of fixing damage incurred in the accident or, if the car is totaled, the fair market value of the vehicle just before the collision occurred.

After your Comprehensive coverage or your Collision coverage has paid you the actual cash value for your vehicle, less your deductible, your Loan / Lease Payoff coverage will pay the difference between the actual cash value and any additional amount you owe under the terms of your vehicle lease or loan (excepting fees and charges).

To be eligible for this plan, state residents should be at least 19, qualify as a «good driver» under the state's guidelines, fulfill lowincome demands, and possess a vehicle which has a value of less than $ 20,000.
