CLC then filed suit against the City alleging that the
zoning ordinance, on its face and as applied,
violated the equal protection rights of CLC and its potential residents.
The court found that the state statutes and local
zoning ordinances imposing spacing and density requirements
violated the FHA prohibition on handicapped discrimination.
