This inquiry, when balanced with consideration of the
parties» needs and compensation for «relationship generated disadvantage», provides broad themes
to assist the court in determining
what is a
fair result in any given case.
In those cases where it
is clear either (a) that the
parties did not intend a joint tenancy at the outset or (b) had changed their original intention, but it
is not possible
to ascertain by direct evidence or by inference
what their actual intention
was as
to the shares in which they would own the property, «the answer
is that each
is entitled
to that share which the Court considers
fair having regard
to the whole course of dealing between them in relation
to the property».
Where it
is clear that the
parties did not intend a joint tenancy upon purchase, or had changed their original intention as
to their beneficial shares, but it
is not possible
to ascertain by direct evidence or inference
what their actual intention
was, each
is entitled
to that share which the court considers
fair having regard
to the whole course of dealing between them in relation
to the property.
Disagreeing with Lord Justice Chadwick's formulation in Oxley v Hiscock [2004] EWCA Civ 546, [2004] 3 All ER 703, that the beneficial interest should
be apportioned

was not the appropriate test.
But by the CJEU's own definition a third
party is to be appointed
to resolve a dispute as
to what constitutes a
fair price for licensing of a SEP..
The district judge at trial agreed with Jones and, having found the presumption rebutted, considered
what was «
fair and just» with regard
to the course of dealings between the
parties, awarding Jones a 90 % share in the property.

is a rather complicated bit of legal procedure, but it does give
parties an incentive
to come up with a
fair offer, lay it all out on the table, and see

party «broker» clinics who facilitate the process for the insurance companies and who according
to various court and FSCO Tribunal decisions manipulate the process and the report and in some instances outright change
what the expert actually reported (see
FAIR (For Accident Insurance Reform) «The Independent Insurer Medical Examination IME / IE»).
The mediator then uses the gathered information
to persuade the
parties to meet in the middle for an amount that the mediator feels
is fair considering
what's been presented.
Costs awards should reflect more
what the court views as a
fair and reasonable amount that should
be paid by the unsuccessful
parties, rather than any exact measure of the actual costs
to the successful litigant.
When considering if the English Court
is clearly the appropriate forum for the dispute
to be determined, the factors the English Court may consider
are wide, and include: (i) the personal connections the
parties have
to the countries which
are relevant
to the dispute (ii) the factual focus of the dispute (i.e. in
what country / countries did the relevant events occur)(iii) factors affecting convenience or expense, such as the location of witnesses and / or documents (iv) applicable law and (v) whether the matter would receive a
fair trial in another jurisdiction.
Cost awards should reflect
what the Court deems
to be a
fair and reasonable amount that should
be paid by the unsuccessful
party (Boucher v. Public Accountants Council for the Province of Ontario (2004), 71 O.R. (3d) 291 at para 24).
