The
timing of Gurley's death comes at a particularly sensitive
time for the department, which is bracing for possible demonstrations and protests in
response to a decision from a grand jury in Ferguson, Missouri, about
whether to proceed with a criminal case against a white
police officer who fatally shot an unarmed teenager.
However, by the
time the accused is given his third opportunity to call a lawyer, has refused for the third
time, and has replied in
response to a question as to
whether he understands, in the affirmative, I am of the view that the
police have complied with their obligations pursuant to s. 10 (b) of the Charter.
