What strategies have you used as a solo attorney
who takes maternity leave, or what practices have you seen used both other solo women lawyers to accomplish a smooth maternity leave?
The employment discrimination listserv has been engaged in a debate about whether women
who take maternity leave should be entitled to the same seniority count as other employees.

(Full disclosure: I have two small children, and after the birth of each I opted to
take the full year of combined
maternity and parental
leave to which I, as a Canadian
who made sufficient contributions to employment insurance, am entitled.
While doing your look back, it's important to
take into account workers
who may be out on
maternity or military service
leave.
Does that mean you should just fire anyone
who wants to
take maternity leave?

taken maternity leave, why not go to them for advice.
I often see mothers
who are stressed over this issue throughout their
maternity leave — instead of enjoying their baby they worry about milk supply, whether their baby will
take a bottle, etc..

But in addition, we'd also like to see conversations about the explicitly gendered nature of child - bearing in legal workplaces, about the fact that male associates don't
take long
leaves because they're (typically) not the partner
who needs to provide direct care to a newborn, and / or because they simply know and assume that their female partners will
take a full year of
maternity leave if available to them.
Sacker & Partners has, for instance, seen impressive results from its efforts, with all of its lawyers
who have
taken maternity leave in the past five years returning to work.
The Regulations do not require employers
who offer enhanced
maternity packages to match those for anyone
taking shared parental
leave.
Whether it is the personal assistant of a famous TV and radio political talk show host (
who was fired on her first day back from
maternity leave), the Pennsylvania bank employee fired because her employer believed (incorrectly) that she was not planning to return to work after giving birth, or the Georgia warehouse worker fired after her doctor gave her a note restricting her from lifting heavy loads, these stories of women facing harm to their employment situations due to their pregnancies

Eligible employees
who are having a baby have the right to
take up to a year of
maternity leave - no matter how long they have worked for an employer.
But I recently had a conversation with a very senior partner
who was kind of resentful that some female associates
take a full year of
maternity leave.
At a recent talk at the University of Ottawa by Cynthia Petersen, the Law Society of Upper Canada Discrimination and Harassment Counsel, raised the idea that women
who go on
maternity leave are severely disadvantaged upon their return, unlike their male counterparts
who take similarly long
leaves for other personal or professional reasons.
These are returning professional internships, which act as a bridge back into senior roles for experienced professionals
who have
taken extended career breaks — in many cases women returning to work after
maternity leave or having
taken a career break to raise children.
Financial institutions have speculated that to be able to afford the SPL packages, companies might cut down on enhancements they currently offer as part of
maternity leave packages, which could put mothers
who do not want to
take SPL at a disadvantage.
There is evidence that women
who take maternity or parental
leaves may experience negative financial consequences.
