REALTOR ® A said this practice by REALTOR ® B created a dilemma for him as the listing broker of either not submitting the offer to the client or, alternatively, paying an amount
of subagency compensation greater than he had offered through the MLS.
However, REALTOR ® B had ignored this information as published by the MLS and had, on two separate occasions, brought REALTOR ® A purchase agreements with copies of deposit receipts that provided for a different amount of
subagency compensation to be payable to REALTOR ® B.
REALTOR ® A filed a listed property with his local MLS offering to pay a fee
for subagency services.
New Registrants or anyone, might reasonably wonder why a Registrant would feel the following kind of profound Representation conflict and not refer the buyer (s) away, in an effort to mitigate the situation: «We're talking
subagency days and very dangerous territory.
REALTOR ® A also complained that the language of the deposit receipt was so phrased as to make presentation of the offer conditioned upon REALTOR ® A's agreement to pay a larger
subagency commission than he had offered through the MLS.

Subagency Agreement,» signed by Marshall and Keeny, was produced to the arbitrators prior to the hearing and was considered as evidence by the panel.

Subagency was the order of the day.
I sold countless numbers of my own listings from opens; but remember we're talking «
subagency» days.
Furthermore,
subagency is dead only because the industry found its self - interests served by shifting the potential liability of incompetent subagents to the rising number of buyer's agents.
The Connecticut rule prohibits licensees from demanding a referral fee unless there's an actual business introduction,
a subagency relationship, a contractual referral - fee relationship, or a contractual cooperative brokerage relationship.
Even after signing exclusive buyer's agent agreements, some buyers think they can still shop around for other salespeople the way they could under
subagency.
Subagency is quickly declining.
Subagency, in retrospect, seemed much easier to work with.
